Terms of Service

01 Agreement to terms

By accessing or using the TEND website or application ("Service"), you agree to these Terms of Service. If you are using TEND on behalf of an organization, you are agreeing on its behalf and confirm you have authority to do so. If you don't agree, don't use the Service.

02 The service

TEND lets publishers and creators bring in content they've created and produce secondary pieces of that content for distribution across channels. We may add, change, or remove features over time to improve the Service.

03 Your account

• You're responsible for the accuracy of your account information and for keeping your credentials secure.
• You're responsible for activity that happens under your account.
• Notify us promptly if you suspect unauthorized use.

04 Your content & license

You keep all ownership of the content you bring into TEND and of the secondary pieces created from it. To operate the Service, you grant TEND a limited license to host, process, transform, and — at your direction — publish that content. This license exists only to provide the Service and ends when you remove the content or close your account.

You represent that you have the rights to the content you connect or upload, and that your use of TEND doesn't infringe anyone else's rights.

05 Acceptable use

You agree not to:

• Use the Service to create or distribute unlawful, infringing, deceptive, or harmful content.
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
• Misuse connected third-party platforms or violate their terms.
• Resell or provide the Service to third parties except as permitted in your plan.

06 Third-party integrations

TEND connects to tools and platforms you choose — media libraries, AI providers, social networks, and more. Your use of those services is governed by their own terms. We're not responsible for third-party services, and their availability may change.

07 Plans & payment

Paid features are billed according to the plan you select. Fees are due in advance and are non-refundable except where required by law. We'll give you notice of any change to pricing that affects your plan.

08 Intellectual property

The Service itself — including TEND's software, design, and brand — is owned by TEND and its licensors and is protected by intellectual property laws. These terms don't grant you any right to our marks or software beyond using the Service as intended.

09 Termination

You can stop using TEND at any time. We may suspend or terminate access if you breach these terms or use the Service in a way that creates risk or legal exposure. On termination, your right to use the Service ends; sections that by their nature should survive will survive.

10 Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted or error-free.

11 Limitation of liability

To the fullest extent permitted by law, TEND will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim.

12 Changes to these terms

We may update these terms from time to time. When we make material changes, we'll update the date above and, where appropriate, notify you in the Service. Continued use after changes take effect means you accept the updated terms.
